The Election is Over II – Now What Does That Mean for Immigration?

Date: 11/19/20
Presenter: David Z. Brown

America has chosen former Vice President Joe Biden as its 46th president. What does that mean for the US immigration? A Biden presidency is suggestive of a return to old immigration policies and a final solution for undocumented populations including Dreamers. Early reporting suggests the Muslim Travel Ban is the first relic of President Trump's legacy to go. Managing Partner, David Zaritzky Brown, gave insight on what to expect in a Biden presidency, both in the first 100 days, and beyond. Also, given the monumental month we've just endured in our field, David did tackle current issues as well.

In dissecting the future of our field David highlighted what employers can do now to prepare for anticipated changes. You won’t want to miss this opportunity to be prepared.

This Webinar covers the same subject matter as our previous presentation hold on Tuesday, November 17th.

Date: 4/9/20 11:00 PM PST (1:00 PM CST/2:00 PM EST)
Presenter: David Z. Brown

Please join David Brown, Managing Partner of Brown Immigration Law, for guidance on how to best manage the impact of the current pandemic on U.S. immigration issues. This is a planned 45 minute update on all the key compliance issues of concern for employers and their foreign staff created by COVID-19 changes. David has been managing employment-based immigration issues for over 22 years, and although this pandemic is wholly unprecedented, he has worked through other interesting periods in our immigration history that offer guidance for this situation. As we know, there is new news every hour of every day, and this is an evolving problem that is constantly changing.

David will synthesize the most important immigration topics you are facing as employers and HR today, including:

* the effects on employees working from home; * how travel restrictions apply to foreign nationals (my visa is expiring soon but I do not want to return to a travel-restricted country); * how government office closures will impact filing options; * the impact of remote instruction at many colleges and universities on student status, and potential issues with graduation delay for OPT (Master Cap filings)

This is just a sample of issues our clients are confronting, and that David will discuss. After the initial presentation David will stay for an extended Q&A period to provide as many answers as possible. H-1B Cap Updates and the Green Card Alternative (Part II):

Date: 4/13/17
Presenter: David Z.Brown

David will provide a brief update on H-1B Cap processing and then discuss an overview of the Green Card process before explaining how the Green Card application is possibly a means around the H-1B Cap limitation. The conservative approach of moving individuals from F, TN, O, J status to H-1 and then commencing a Green Card worked in a world where the H-1 was accessible and likely. Under our current H-1B drought it makes sense to plan for alternatives, and a Green Card, if done correctly may be a good option for ensuring continuing employment for key new employees. This requires a paradigm shift for some organizations in terms of immigration benefits policy and may require new approaches to employee reviews before making such commitments. David will cover all of these issues and help participants understand that the Green Card may be a better option over some of the available non-immigrant status choices.

H-1B Cap Updates and Contingency Planning (Part I): https://attendee.gotowebinar.com/recording/3452500969036419329
Date: 3/1/2016 2:00 PM CST
Presenter: David Z. Brown

David will first provide updates on the H-1B Cap Season and any additional information on the EAD STEM allowance. And as we finalize preparations for H-1B filing season it’s no fun to be thinking of alternate means of employing new or existing hires if they don’t receive an H-1B in the Cap lottery. However, it is important that we consider all angles because we know a significant number of applicants will not be chosen in the lottery. We also know that once this season’s H-1s are all snapped up, we’ll have a drought of H-1s again for another 18 months unless Congress intervenes – it being an election year the chance of reform is currently zero. Please join us for a discussion about alternate visa classifications and ways to manage recruiting when no H-1s are available. This still means you can recruit individuals who are already in the U.S. in H-1 status, but it also means you need to look closer to see if any of your candidates qualify for TN, L, O, E, F, J or dependent L or E spouses. There are even more options depending on the type of candidate you have and David will also discuss the option of cap exempt organizations and how to claim such status if you are a private employer. At the end of this video chat you'll have a better sense of the other status options to help with your recruiting and hiring of foreign talent in a world where the “what if” becomes reality.
