David will provide a brief update on H-1B Cap processing and then discuss an overview of the Green Card process before explaining how the Green Card application is possibly a means around the H-1B Cap limitation. The conservative approach of moving individuals from F, TN, O, J status to H-1 and then commencing a Green Card worked in a world where the H-1 was accessible and likely. Under our current H-1B drought it makes sense to plan for alternatives, and a Green Card, if done correctly may be a good option for ensuring continuing employment for key new employees. This requires a paradigm shift for some organizations in terms of immigration benefits policy and may require new approaches to employee reviews before making such commitments. David will cover all of these issues and help participants understand that the Green Card may be a better option over some of the available non-immigrant status choices.
